On May 28, 2024, Decree of the President of the Republic of Belarus dated February 23, 2024 No. 69 “On amending the decrees of the President of the Republic of Belarus” comes into force, which improves the procedure for providing family capital.
The right to early disposal of family capital to improve housing conditions can be exercised provided that the family does not own residential premises in the territory of the Republic of Belarus, in which the provision of a total living area of 15 square meters or more per person, in Minsk - 10 square meters and more per person.
Also, if funds are used early to receive medical services, it will be possible to use family capital only if such services are received in a state-owned health care organization. At the same time, it is envisaged that family capital will be used in parts to receive dental services. Thus, upon concluding an agreement, 50% of the family capital funds required under this agreement will be transferred immediately, and the final payment will take place after the provision of a certificate of completion of work.
Changes also affected education. Now, when paying for education services, it is stipulated that payment from family capital will be made in installments, i.e. for only one year of study. And so on every year until graduation.
The decree also introduced additional conditions for the assignment of family capital and early disposal of its funds. A condition has been introduced such as the employment of an able-bodied father, stepfather in a complete family, parent in a single-parent family, i.e. on the date of application for the assignment of family capital, an able-bodied father in a complete family must work for at least six months in the 12-month period before the month of application.
The right to early disposal of family capital is similarly linked to the father’s employment. If a family wishes to use these funds in any of the areas, an able-bodied father, stepfather in a two-parent family, or parent in a single-parent family must be employed for at least 12 months in the two-year period before applying.
This measure is aimed at increasing the social responsibility of the family to ensure their well-being. Also, family capital is not provided if children are recognized as being in a socially dangerous situation or taken away from the family.
A ban has been established on the alienation of residential premises acquired using family capital for 5 years from the date of registration of ownership of residential premises, which have been registered since 2020. The procedure for returning unreasonably used funds to the republican budget in case of violation by citizens of the requirements of the legislation on family capital has also been regulated.
