Decree of the President of the Republic of Belarus dated January 25, 2024 No. 32 “On automobile transportation of passengers” (hereinafter referred to as the Decree) provides for the creation of a state information resource “Register of automobile transportation of passengers in irregular traffic” (hereinafter referred to as the Register), which includes information including about road carriers, vehicles (buses, cars, taxis) and about drivers of vehicles carrying out road transport of passengers in irregular traffic.
Inclusion of information in the register is carried out by the Transport Inspectorate on the basis of applications from road carriers.
Such inclusion in the period from August 1, 2024 to October 31, 2024 is carried out without paying a state fee. At the same time, the performance of automobile transportation of passengers in irregular traffic without inclusion of information in the register until October 31, 2024 is not prohibited.
When carrying out road transport of passengers in irregular traffic, the road carrier is obliged to ensure timely inclusion of information in the register, the introduction of changes to it, including the operation of vehicles and the work of drivers, and also to maintain their relevance.
The driver is obliged:
carry out automobile transportation of passengers in irregular traffic, subject to the availability of information about him and the vehicle in the register;
when receiving and transmitting orders using information systems and resources, proceed with road transportation of passengers in irregular traffic only if orders are received from road carriers, dispatchers of road transportation of passengers in irregular traffic, taxi dispatchers, information about which is included in the register;
during the work shift, ensure video recording of the performance of automobile transportation of passengers in irregular traffic, storage of the received data.
Carrying out automobile transportation of passengers using information systems and resources, information about which is not in the register, is illegal and prohibited.
The requirements for vehicles, as well as for drivers, are established respectively by Chapters 2 and 3 of the Rules for the Road Transportation of Passengers, approved by Resolution of the Council of Ministers of the Republic of Belarus dated June 30, 2008 No. 972.
Responsibility
If there are grounds provided for by the Decree, the presence in the Register of information regarding the driver, vehicle, or motor carrier may be suspended, and information regarding the motor carrier may be excluded from the Register.
In addition, a motor carrier, as well as its driver, when carrying out road transport of passengers in irregular traffic without inclusion of information in the Register, as well as during the period of suspension of information in the register, are subject to administrative liability.
